Tell The Labour Minister: Don't strip WestJet flight attendants of their right to strike

The federal government must respect the collective bargaining rights of 4,400 WestJet flight attendants and ensure their guaranteed right to strike remains protected.

WestJet Flight attendants with CUPE Local 8125 are fighting to end the exploitative practice of unpaid work.

When you are walking down the aisle, struggling to fit your bag in the overhead bin, the person helping you isn't getting paid. WestJet flight attendants are not paid until the aircraft doors close and the brakes are off!

It’s simply unfair and it needs to end.

The union has a 99% strike vote mandate from their membership that is undeniable.

The right to strike is supposed to be guaranteed by the Canadian Charter of Rights and Freedoms.

But the federal government has recently started to strip away the right to strike using a draconian section of the Canada Labour Code referred to as Section 107.

Nobody wants a strike. But when the right to strike is removed, so is the incentive for large corporations to negotiate in good faith with their employees. When they know the government will step in, they can simply let the clock run out and wait to be bailed out before making meaningful concessions.

But the government doesn’t have to get involved. They can simply let the bargaining process continue without interference.

The right to strike must be protected for everyone. If one group of workers has this right taken away, every union members’ rights will increasingly be at risk.

We need the Minister of Labour to respect labour, respect work, and respect Canadian workers.

Your government needs to respect WestJet flight attendants’ right to strike and allow collective bargaining to work.

We know you understand what's right when it comes to fair treatment for Canadian workers. That's why we are asking you to let the process unfold. Collective bargaining and the right to strike are protected rights in Canada, not tools to be set aside to protect an airline's profit margins.

I am calling on you to publicly commit that your government will not invoke Section 107 of the Canada Labour Code or pressure the Canada Industrial Relations Board (CIRB) to force WestJet flight attendants back onto planes.

This dispute belongs at the bargaining table between WestJet and CUPE 8125, not in Cabinet. Even the airline's CEO has publicly acknowledged a desire to make things happen and reach a resolution, so let the parties do the work.

WestJet flight attendants are fighting a system of unpaid work. Time on the ground and in the cabin, where they are legally required for the safety of millions of Canadians who fly every day, remains completely unpaid. No Canadian should have to strike to win the basic right to be paid for all the hours they are at work.

Armed with a historic 99% strike vote, the workers' message is clear. Using Section 107 or back-to-work powers to crush this strike violates the Canadian Charter of Rights and Freedoms. The stakes for all of labour are huge: we need a government that respects labour, respects the work itself, and respects Canadian workers.

To the federal government: stay out of this dispute, and we can help find a fair resolution at the table. I expect you to move quickly to close the unpaid-work loopholes in the Canada Labour Code.
